SECTION 47A FAIR TRADING ACT 1987 (NSW) DISCLOSURE
The below disclosure only applies if you (“You”) are a consumer (as defined by the Australian Consumer Law) and are receiving the supply of goods or services from TGSA Pty Ltd as trustee for Cornerpath Trust (ABN 90 913 873 797) (“Net Nudge”) within the state of New South Wales.
Before You enter into the Terms of Use with Net Nudge (“Agreement”), Net Nudge draws Your attention to the following terms and conditions (in summary form) which are contained in the Agreement:
The Agreement automatically renews unless it is cancelled by You.
If you sign up for a ‘free trial’ to Net Nudge’s software, this will automatically change to a paid plan after the expiry of the ‘free trial’ period unless it is cancelled by You.
c. Net Nudge may terminate the Agreement at its discretion by providing you with at least 60 days’ notice.
d. Net Nudge excludes its liability to You for certain categories of loss or damage such as indirect or consequential losses, loss of data and loss of profits (among others).
e. Net Nudge’s liability to You for direct losses is limited.
f. Net Nudge may, in accordance with its Privacy Policy, provide personal information it collects from You to third parties (such as in order to provide its service to You, among others).
g. If Net Nudge terminates the Agreement because You breached its terms, then You will forfeit all the fees that You have prepaid for Net Nudge’s goods or services.
h. Net Nudge may, upon the provision of notice to You, unilaterally amend the terms of the Agreement (including the fees that You must pay) with effect from the Agreement’s next renewal date following a notice period.
i. You must indemnify Net Nudge against loss and damage caused by You in certain circumstances (such as where Your data causes Net Nudge loss, where You breach applicable laws or You infringe Net Nudge’s intellectual property rights, among others).
j. Net Nudge may suspend Your use of its software under certain circumstances (such as where there is a breach of the Code of Conduct).
